Terms & Conditions of Service
Ninda Toor Transport LtdBy engaging Ninda Toor Transport Ltd (“we”, “our”, or “us”) to carry out transport or storage services, you (“the client” or “customer”) agree to be bound by the following terms and conditions. These terms govern all aspects of our working relationship unless otherwise agreed in writing.
1. Carriage of Goods
All goods transported by Ninda Toor Transport are subject to the current Road Haulage Association (RHA) Conditions of Carriage. These conditions outline our liability and responsibilities regarding loss, damage, and delivery obligations. Clients are encouraged to review the full RHA Conditions, which are available upon request.
2. Storage of Goods
Where applicable, goods stored with us will be done so under the standard RHA Conditions of Storage, unless an alternative agreement has been made in writing. These conditions include terms covering liability for loss or damage during storage and the responsibilities of both parties regarding stored goods.
3. Waiting Time at Collection/Delivery Points
We allow up to 90 minutes of waiting time per collection or delivery location as standard. If waiting time exceeds 90 minutes, a surcharge of £50.00 per hour or part thereof will be applied to cover operational and driver costs. It is the responsibility of the client to ensure that loading and unloading operations can be carried out within this timeframe unless prior arrangements are made.
4. Pricing and VAT
All prices quoted or agreed upon are exclusive of VAT, which will be charged at the prevailing standard UK rate in accordance with HMRC regulations. Additional services, waiting time, or special handling may incur further charges.
5. Payment Terms
Our standard payment terms are 30 days from the end of the month (EOM) in which the invoice is issued. Late payments may be subject to: Statutory interest in accordance with the Late Payment of Commercial Debts (Interest) Act 1998Administration fees or recovery costs if passed to a debt collection agency Suspension or termination of services in the case of persistent late payment
6. Proof of Delivery (POD)
Electronic Proof of Delivery (POD) documents will be provided by email upon completion of each job.If original hard copies are required, a written request must be submitted within five (5) working days of job completion. Requests made after this period may not be fulfilled or may incur administrative charges.
7. Legislative and Regulatory Changes
In the event of any new legislation, regulatory requirements, fuel surcharges, or enforced changes during the contract period, Ninda Toor Transport reserves the right to adjust pricing and service terms to reflect any additional operational costs incurred. Clients will be notified in writing of such changes and their effective date.
8. Liability and Insurance
Our liability for loss or damage to goods is limited as per the applicable RHA Conditions. It is the client’s responsibility to ensure that any goods of high value or special nature are declared prior to transport so that appropriate cover or special arrangements can be discussed. Additional insurance may be arranged upon request and at the client’s cost.
9. Cancellation and Delays
If a job is cancelled by the client with insufficient notice (typically less than 24 hours), cancellation fees may apply. Delays caused by the client (e.g., goods not ready, incorrect address, lack of access) may incur additional charges.
10. Force Majeure
We are not liable for failure or delay in performance caused by events outside our reasonable control, including but not limited to natural disasters, severe weather, strikes, road closures, or fuel shortages.
11. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
